Mr. X has briefed me on your phone call to him today.

Per the attached agreement, you were supposed to provide the following :

SPECIFICATION: 6mm single glazed glass (tint or plain glass), Treated wood (Dasban, Stain, Icsam Hardner, Icsam Lacquer), Brass Hinges and Aluminum Handles

Slide through Mosquito Net, Projected Window.

However, you did not complete the following:

1. Treated wood (Dasban, Stain, Icsam Hardner, Icsam Lacquer) – We have completed this at our own cost,

2. Brass Hinges - We provided this at our own cost.

3. Aluminum Handles.

4. Slide through Mosquito Net.

5. Projected Window

To avoid escalating this case to a civil complaint and or other actions, we request that Walk-On-Wood complete the following:

1. Install all Aluminum Handles.

2. Install all Slide through Mosquito Net.

3. Complete all Projected Windows.

4. Return all the glass purchased for the front open space.

Alternatively you can give us a refund for the uncompleted 4 projects. Please do inform us as to if and when you plan to go to the site to resume work .

please i lost your phone number so please try and call me so we'll know the way forward cos, as far as am concern, you have taken the job of me and ordered not allow me on site  and therefore, you have found one of my workers(michael) whom you think is capable of finishing the job, X can confirm that. He is the same person who deliberately cut the glasses wrongly.
I know there are lots of jobs on site worth more than the windows so why would screw up. even that week that you sanctioned me from the site, i had already installed some of the windows in bedroom and i was going back to drop rest for my guys the next day.
i had wanted to finish before calling u but, since you didn't know anything about it you ordered michael to take up the job who i believe teamed up with vincent who has been stealing material on site.
i believe we need to talk on fone.

Dear WALK ON WOOD GHANA,

This email is just to notify you that myself and my wife will be proceeding to file a civil complaint against your firm on account of displeasure we have with the services rendered so far. We will also make a point of advertising to potential clients the significant pitfalls of doing business with you.

As the below email chain documents, we have paid more than 100% of the costs associated with the window installations at our property in Prampram, Greater Accra Region yet have received no more than 70% in commensurate service execution. After providing you with window hinges out of pocket, on June 2010 Otuo requested for another 3250ghc to help him complete the job but he never did complete the job. Otuo came asking for more funds for misfit frames and broken glasses. To date, the window screens and locks have not been provided. The payment represents more than the agreed upon portion that was required for installation completion consequently at this point WE WILL NOT REMIT ANY FURTHER FUNDS associated with this contract, and will report you to the relevant authorities for non-performance of contractual obligations.

Your internal operating issues as a business have no bearing on the contractual obligations you entered in to regarding our window installation, your explanation vis a vis cash flow problems is not a justifiable excuse ESPECIALLY WHEN IT IMPLIES THAT YOU ARE PENALIZING THOSE CUSTOMERS LIKE US WHO HAVE PAID YOU PROMPTLY FOR WORK EXPECTED ON ACCOUNT OF DIFFICULTIES YOU ARE ENCOUNTERING WITH OTHER SEGMENTS OF YOUR CLIENTELE. That is unacceptable to us and unjust since no where in the agreement we entered in to with you did you clearly spell out that work performance was contingent on business cash flow, a fact that obviously would have disqualified you from getting our business.

We reserve the right to file a civil complaint against your firm on account of displeasure, lack of performance with the services rendered so far. We may also place an advert in the daily news papers detailing the disingenuous and lack of honesty by some of your staff as well as the bad experience we have had with Walk On Wood Ghana. Better yet, we will post articles on every Ghanaian news room and every Ghanaian blog on the web and other sites including Facebook and Twitter detailing to your potential clients the significant pitfalls of doing business with Walk On Wood Ghana.

As a courtesy, My wife and I will give Walk On Wood Ghana from now till December 31st 2010  to correct this issue before we escalate it to the next level.

10 reflective 6mm sheets = 10 x 165GHC = 1,650GHC – First Floor

8 plain 6mm sheets = 8 x 120GHC = 960GHC – Second Floor

Total = 2,610GHC.

Sorry Mr Myles, for the delay in communication.
Like i was discussing with u on the fone we need 13sheets of the reflective glass to complete the once down stairs. One at moment cost Ghc150.00 per sheet which is =1950Ghc. Also class, we need 9sheets and one cost Ghc90.00 per sheet = 810Ghc. pls dont forget that we added some more window and modifications as well. I am still waiting to hear from you. Per our phone conversation on June 16, 2009 you promised to send me information on the number of sheets you need for the plain glass for the second floor and reflective glass for the first floor. Out of the 19sheets, how many will be plain glass and how many will be reflective glass?

I will appreciate prompt response to my emails so we that we can plan ahead.

You had a lot going for you and now you are messing everything up. As you can see the windows is just a small piece of the project but now you make us wonder if you can even do the flooring and the others.

thanks for the mail.
My initial invoice to you, i included a plain glass or reflective glass. later we decided to use plain reflective glass which is 6mm type. at that time the plain glass cost ghc80.00 per sheet. Now the plain glass cost Ghc120.00. For the reflective 6mm glass, is Ghc165.00 per sheet.
At the moment, i been able to buy 13sheets (reflective glass) out of 32sheets.
Mr myles, am not in position to mess you up, things are changing quick n fast, even since you left, fuel has being increase(30%). this has  cos inflation.
Also rushing to complete the job @ site has also taken much of the money.
Mr Myles, i have lost in this project but i am ask u to bare it. my wish is to finish job n maintain a good relationship beyond this.
we return to work on monday 22' june. to polish and fix the glass that i have the moment.

We have paid Walkonwood 15,900GHC out of 18,425GHC which makes it 86% of the total charge so for you to have stopped working baffles me a lot. We are left with 2,525GHC so are you saying that you need this balance before you can complete the job?

So the Grand Total for the windows alone will come to GHC18,425?

Initial Quote = Ghc17,725.00

1700x200x2 = Ghc  4,00.00 Additional Windows

1700x3200x1=Ghc  3,00.00 Additional Window.

Grand Total = GHC18,425.

Please send me an updated contract for the windows so both of us can sign it.

Doors:

Let us arrange to meet sometime this week to take a look at the doors before we commit.

Hardwood Floor:

We need to talk a bit more about this. I think it will be fair to complete the Windows and may be the Doors to gauge how satisfied we are before moving on the flooring.

Additional window(fixed) Huge one:FREE
Total cost:Ghc3,700.00
Also as discussed regarding the Hardwood Floor, i will appreciate if 30% comitment fee is paid so as to purchase the the wood for drying. Total cost: $9000.00 which is Ghc12,600.00 and 30%=Ghc3,700.00
For the windows and Doors, a part payment of @ least Ghc2,300.00 within a short time if possible.
